By accessing or using the Shamillaa website (shamillaa.com and www.shamillaa.com), you agree to be bound by these Terms of Service, our Privacy Policy, and our Cookie Policy, which are incorporated herein by reference. If you disagree with any part of these terms, you may not access our services.

You may use our site only for lawful purposes. You agree not to use the site in any way that violates any applicable local, national, or international law or regulation, including but not limited to:

• Submitting fraudulent orders
• Using automated systems (bots, scrapers) to access the site without authorization
• Attempting to interfere with the site's functionality or security
• Impersonating any person or entity

To place orders and access certain features, you may need to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password confidential and not share it with any third party
• Accept responsibility for all activities that occur under your account

You must be at least 16 years of age to create an account. We reserve the right to suspend or terminate accounts that violate these terms.

We make every effort to display as accurately as possible the colors, features, and details of our products. However, we do not guarantee that your computer monitor's display of any color will be accurate. All prices are displayed in US Dollars and are subject to change without notice. If a product is listed at an incorrect price due to a system error, we reserve the right to cancel any orders placed at the incorrect price and will notify you promptly. We will either offer the product at the correct price or cancel the order with a full refund.

Submitting an order constitutes an offer to purchase. We reserve the right to accept or decline any order. An order is considered accepted when we send you an order confirmation email. You may cancel an order within 1 hour of placement by contacting [email protected]. After processing has begun, cancellation is no longer available; you may instead request a return per our Return Policy once the item is delivered. If an ordered item is unavailable, we will notify you and offer a comparable alternative, a backorder option, or a full refund.

All purchases are subject to our Return Policy, which allows returns and exchanges within 30 days of delivery for eligible items. Key points:

• Unworn, unwashed, unaltered items with original tags attached are eligible
• Sale, personalized, and made-to-order items are excluded unless damaged
• A $7 return shipping fee applies to US domestic returns
• International orders are not eligible for free returns

By placing an order, you acknowledge and agree to these return terms.

Shamillaa products are crafted with premium materials including our signature SilkWool Tech fabric. We stand behind the quality of our garments. If you receive a product with a manufacturing defect (e.g., fabric flaw, stitching error, or structural issue not caused by wear or misuse), please contact us within 30 days of delivery for a replacement or refund. Disclaimer: Our products are designed for professional and everyday wear. Fabric performance features (wrinkle resistance, stretch recovery) may diminish over time depending on care practices and frequency of use. We provide recommended care instructions on each product page and our FAQ. Shamillaa does not warrant against normal wear and tear, misuse, improper care, or alterations made by you or a third party.

The Service and its original content, features, and functionality are and will remain the exclusive property of Shamillaa and its licensors. Our brand name, logo, and designs are protected by copyright and trademark laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any part of our content without prior written consent.

In no event shall Shamillaa, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service, including but not limited to loss of profits, data, goodwill, or other intangible losses. Maximum liability cap: Shamillaa's total aggregate liability for any and all claims arising from or related to your use of our Service or purchase of our products shall not exceed the amount you paid for the specific product giving rise to the claim.

You agree to indemnify, defend, and hold harmless Shamillaa and its directors, employees, partners, agents, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of our products or website, your violation of any applicable law or regulation, or any content you submit or transmit through our services.

Informal resolution: If you have a concern or dispute, we encourage you to first contact us at [email protected]. Most issues can be resolved quickly through direct communication.

Arbitration: If informal resolution is unsuccessful, you and Shamillaa agree to resolve any disputes through individual (non-class) arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will be conducted in New York, New York. The arbitrator's decision is final and binding. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

Class action waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive the right to participate in a class action lawsuit or class-wide arbitration against Shamillaa.

Small claims exception: Either party may bring claims in small claims court, provided the claim is within that court's jurisdictional limits and is brought on an individual basis.

These Terms of Service shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any disputes not subject to arbitration (as described in Section 11) shall be resolved in the state or federal courts located in New York County, New York.

We reserve the right to terminate or suspend your account at our sole discretion, without prior notice, for conduct that we determine violates these Terms, is harmful to other users or our business, or for any other reason we deem appropriate. Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination (Sections 7, 8, 9, 10, 11, 12) shall remain in effect.

We may update these Terms of Service from time to time. When we make material changes, we will notify you by placing a prominent notice on our website or by sending an email to the address associated with your account. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
